These Terms & Conditions (“Terms”) govern your access to and use of our website, digital platforms, customer communication services, and messaging channels including WhatsApp Official API and Rich Communication Services (RCS).

By accessing our website, communicating with us digitally, or receiving messages from us, you agree to comply with and be bound by these Terms.

These Terms are drafted in accordance with the Information Technology Act, 2000, applicable rules thereunder, the Digital Personal Data Protection Act, 2023, and Meta & telecom operator compliance standards.

  • “Business”, “We”, “Us”, or “Our” refers to Akshay Agro.
  • “User”, “You”, or “Your” refers to any individual or entity accessing our services or communication channels.
  • “Services” refers to agro-related offerings, customer support, notifications, updates, promotional messages, and transactional communications delivered through digital platforms.
  • “WhatsApp Official API” means Meta-approved WhatsApp Business messaging services.
  • “RCS” means Rich Communication Services provided through telecom operators.
  • “Content” includes text, images, trademarks, messages, and other materials shared by Akshay Agro.

3. Acceptance of Terms

By using our website, contacting us, registering interest, placing inquiries, or opting in to receive WhatsApp or RCS messages from Akshay Agro, you expressly acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree, you must discontinue use of our services and communication channels.

4. Description of Services

Akshay Agro provides agro-based products and related commercial services. To enhance customer experience, we use digital communication channels to deliver:

  • Order confirmations and service updates
  • Product availability and pricing information
  • Customer support and grievance responses
  • Transactional alerts and business notifications
  • Promotional or informational messages (only with consent)

We do not provide unlawful, misleading, or prohibited services and strictly follow Meta and telecom messaging guidelines.

5. Eligibility

  • You must have the legal capacity to enter into binding agreements

Use by minors is strictly prohibited unless supervised by a legal guardian.

6. Account Registration

All payments are subject to applicable Indian tax laws.

9. Subscription Renewal & Termination

If any subscription-based communication or service model is introduced:

  • Subscriptions may renew automatically unless canceled
  • Akshay Agro reserves the right to suspend or terminate services for violations
  • Users may opt out of promotional messaging at any time

Termination does not affect accrued rights or obligations.

10. Use of WhatsApp Official API & RCS

Akshay Agro uses Meta-approved WhatsApp Business API and RCS channels strictly for compliant communication. Users acknowledge that:

  • Messages are sent only after explicit opt-in
  • Templates follow Meta and telecom approval rules
  • Opt-out options are always provided

We do not engage in unsolicited or bulk spam messaging.

11. Message Delivery & Compliance Policy

Message delivery depends on network availability, user device compatibility, and third-party platforms. Akshay Agro is not liable for delays or failures caused by Meta, telecom operators, or technical issues.

All communications adhere to:

  • Meta Business Messaging Policy
  • TRAI and telecom regulations
  • Anti-spam and consumer protection laws

12. Intellectual Property Rights

All trademarks, logos, content, and messaging materials belong exclusively to Akshay Agro. Unauthorized copying, reproduction, or commercial use is strictly prohibited.

13. Confidentiality

Any non-public business information shared is confidential and shall not be disclosed without prior written consent unless required by law.

14. Disclaimer of Warranties

Services are provided on an “as-is” and “as-available” basis. Akshay Agro disclaims all warranties, express or implied, including fitness for a particular purpose or uninterrupted availability.

15. Limitation of Liability

To the maximum extent permitted by law, Akshay Agro shall not be liable for indirect, incidental, or consequential damages arising from use of services or messaging channels.

16. Indemnification

17. Governing Law (India)

These Terms shall be governed by and construed in accordance with the laws of India. Courts in Kolhapur, Maharashtra shall have exclusive jurisdiction.
